What is a Short Sale?
A short sale is the sale of property where the mortgage company allows the borrower to sell their property for less than the balance owed on the property loan. When a borrower is experiencing a hardship and cannot pay the mortgage loan,and there is not enough equity to sell and pay all the costs of a sale,the lender agrees to sell the property short or at an amount less than what is owed on the loan. This process allows the owner to avoid foreclosure.
What is Foreclosure?
A foreclosure is a legal proceeding in which a lender or lien holder may repossess the property that a borrower has obtained a loan against. When a borrower fails to pay and falls behind on payments, the lender or lien holder takes the property back and sells the property. The lender will sell the property and keep the proceeds to pay off the mortgage and any legal costs involved. The foreclosure is reported on the borrowers credit.
